When a person dies, in most cases the Executor of the Will must apply for Probate. Probate is the legal process whereby the persons will is accepted as a valid document in a court of law and the administration of the estate itself which enables the final wishes of the deceased to be carried out.
Once Probate has been granted, the Executor must collate all assets (bank accounts, property, shares etc) and use them to settle all liabilities such as bills, taxes and debts. Once this has been done, the remainder of the estate must be distributed to beneficiaries in accordance with the deceased’s wishes as outlined in their Will.
